Hacia atr\u00e1s no permiten la actualizaci\u00f3n, en l\u00ednea con el dictamen de la&nbsp;<strong>Direcci\u00f3n Nacional de Impuestos<\/strong>&nbsp;de diciembre pasado que estableci\u00f3 que las normas legales vigentes no permit\u00edan el ajuste. Los quebrantos (<strong>p\u00e9rdidas fiscales<\/strong>) se pueden computar por cinco a\u00f1os y si no se actualizan solo se pueden deducir a valores nominales lo que hace que se pague m\u00e1s impuesto.<\/p>\n\n\n\n<p>De acuerdo con esto, una parte de los tributaristas sostiene que no aceptar la actualizaci\u00f3n, sobre todo para per\u00edodos de alta inflaci\u00f3n, es un abuso por parte del Estado.&nbsp;<strong>Pagar impuestos sobre ese \u201cno reconocimiento\u201d es un avasallamiento de la capacidad contributiva, en muchos casos, es confiscatorio y afecta el derecho a la propiedad privada.<\/strong><\/p>\n\n\n\n<p>(&#8230;)<\/p>\n\n\n\n<p>En este sentido, el tributarista y socio de\u00a0<strong><a href=\"https:\/\/auren.com\/ar\/\">Auren<\/a><\/strong>,\u00a0<strong><a href=\"https:\/\/www.linkedin.com\/in\/guillermopoch\/\">Guillermo Poch<\/a><\/strong>\u00a0apunt\u00f3 que en\u00a0<strong>2023<\/strong>\u00a0la inflaci\u00f3n fue tan grande que la mayor\u00eda de las empresas dieron quebrantos derivados \u2013principalmente\u2013 del ajuste por inflaci\u00f3n (<strong>est\u00e1tico<\/strong>) y si las compa\u00f1\u00edas los computaran actualizados en la posici\u00f3n del ejercicio\u00a0<strong>2024<\/strong>, este a\u00f1o no pagar\u00edan impuesto a las ganancias. \u201cEn efecto, dar\u00eda la impresi\u00f3n que emiten el dictamen para robustecer la posici\u00f3n fiscal de no actualizaci\u00f3n y de esa manera hacer hincapi\u00e9 m\u00e1s en la recaudaci\u00f3n que en la equidad, pues tendr\u00edan una fuerte ca\u00edda en el ingreso de este gravamen\u201d, afirm\u00f3.<\/p>\n\n\n\n<p>Leer la nota completa en <a href=\"https:\/\/www.lanacion.com.ar\/economia\/ley-de-quebrantos-el-gobierno-desperto-la-polemica-por-un-proyecto-en-el-que-no-se-hace-cargo-de-la-nid19012025\/\">La Naci\u00f3n<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El texto admite la actualizaci\u00f3n por el IPC, pero solo para ejercicios fiscales desde el 1\u00b0 de enero de este a\u00f1o; para algunos especialistas podr\u00eda ser confiscatorio.
