{"id":11743,"date":"2012-06-29T12:26:02","date_gmt":"2012-06-29T10:26:02","guid":{"rendered":"https:\/\/auren.com\/uy\/new\/76-una-ley-por-mayor-igualdad\/"},"modified":"2012-06-29T12:26:02","modified_gmt":"2012-06-29T10:26:02","slug":"76-una-ley-por-mayor-igualdad","status":"publish","type":"new","link":"https:\/\/auren.com\/uy\/noticias\/76-una-ley-por-mayor-igualdad\/","title":{"rendered":"76- UNA LEY POR MAYOR IGUALDAD"},"content":{"rendered":"<p class=\"has-text-align-justify\">Algunas empresas tienen como modalidad en sus procesos de selecci\u00f3n o a la hora de realizar ascensos la solicitud de una declaraci\u00f3n de no estar en estado de gravidez.<\/p>\n<p class=\"has-text-align-justify\">Se ha promulgado la <strong>Ley N\u00ba 18.868<\/strong> la cual proh\u00edbe toda certificaci\u00f3n o declaraci\u00f3n de ausencia de estado de gravidez como requisito de ingreso o permanencia en cualquier cargo o empleo, tanto en la actividad p\u00fablica como privada.<\/p>\n<p class=\"has-text-align-justify\">La Inspecci\u00f3n General del Trabajo y de la Seguridad Social del Ministerio de Trabajo y Seguridad Social ser\u00e1 quien se encargar\u00e1 del cumplimiento de la ley y de la aplicaci\u00f3n de las sanciones, que podr\u00e1n ser administrativas o econ\u00f3micas, en caso de incumplimiento de la misma. Si hubiere sanciones econ\u00f3micas, el dinero recaudado se destinar\u00e1 al Plan Nacional de Igualdad de Oportunidades y Trato en el Empleo.<\/p>\n<p class=\"has-text-align-justify\">Se dispone adem\u00e1s que la constataci\u00f3n de la exigencia del test ser\u00e1 calificado de muy grave, \u201caplic\u00e1ndose al infractor las m\u00e1ximas sanciones administrativas\u201d.<\/p>\n<p class=\"has-text-align-justify\">El <strong>Decreto N\u00b0 186\/004<\/strong> distingue a las infracciones en leves, graves y muy graves y dispone para este \u00faltimo tipo de infracci\u00f3n una multa para el incumplidor que oscila entre 50 a 150 jornales por cada trabajador afectado.<\/p>\n<p class=\"has-text-align-justify\">Esta no ser\u00eda la primera ley vinculada a la maternidad en el sector laboral.<\/p>\n<p class=\"has-text-align-justify\">Desde el a\u00f1o 1950 est\u00e1 vigente la <strong>Ley N\u00ba 11.577<\/strong>, la cual determina que toda mujer en estado de gravidez tendr\u00e1 derecho a ausentarse del trabajo por el tiempo indispensable seg\u00fan prescripci\u00f3n m\u00e9dica.<\/p>\n<p class=\"has-text-align-justify\">La trabajadora no podr\u00e1 ser despedida y en caso de serlo, el patr\u00f3n deber\u00e1 pagar el importe equivalente a seis sueldos m\u00e1s la indemnizaci\u00f3n legal que corresponda. Esta ley es un medio fundamental de protecci\u00f3n a la maternidad.<\/p>\n<p class=\"has-text-align-justify\">Por otra parte, la <strong>Ley N\u00ba 17.215<\/strong> de 1999 establece que la trabajadora que se encontrare en estado de gravidez o en periodo de lactancia puede solicitar un cambio temporario de tareas si las mismas por su naturaleza pudieran afectar la salud de la progenitora o del hijo.<\/p>\n<p class=\"has-text-align-justify\">Existen otras disposiciones que amparan el trabajo de la mujer:<\/p>\n<p class=\"has-text-align-justify\">&#8211; <strong>Ley de la silla<\/strong>, las empresas que contraten personal femenino est\u00e1n obligadas a tener un n\u00famero suficiente de sillas.<\/p>\n<p class=\"has-text-align-justify\">&#8211; <strong>Lactancia<\/strong>, la empleada est\u00e1 autorizada a interrumpir su trabajo para ese fin durante dos periodos de media hora.<\/p>\n<p class=\"has-text-align-justify\">&#8211; <strong>Igualdad de sexos<\/strong>, se proh\u00edbe toda discriminaci\u00f3n que viole ese principio en cualquier sector del ramo de actividad.<\/p>\n<p class=\"has-text-align-justify\">&#8211; <strong>Licencia extraordinaria por examen ginecol\u00f3gico<\/strong>, se otorga \u00a0un d\u00eda\u00a0 al\u00a0 a\u00f1o\u00a0 de\u00a0 licencia extraordinaria\u00a0 con\u00a0 goce\u00a0 de\u00a0 sueldo\u00a0 a\u00a0 efectos\u00a0 de\u00a0 concurrir\u00a0 a realizarse ex\u00e1menes de papanicolau y\/o radiograf\u00eda mamaria.<\/p>\n<p class=\"has-text-align-justify\">Con esta ley no solo se busca fomentar el derecho al trabajo, sino tambi\u00e9n a la maternidad, a la privacidad y a la igualdad entre mujeres y hombres en el empleo.<\/p>\n<p><!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Algunas empresas tienen como modalidad en sus procesos de selecci\u00f3n o a la hora de realizar ascensos la solicitud de una declaraci\u00f3n de no estar en estado de gravidez.
