Relief for companies regarding disclosure

Companies are continuing to struggle with the consequences of the COVID-19 pandemic. To ease the burden on the companies concerned, the Federal Office of Justice (Bundesamt für Justiz, BfJ) has now decided to provide some relief regarding disclosure and filing obligations.

The relief applies to companies whose statutory deadline for disclosing accounting documents for the financial year with the balance sheet date of 31 December 2021 ends one year later on 31 December 2022. The BfJ will not initiate administrative fine proceedings against them before 11 April 2023.

It should be noted, however, that this does not exempt businesses from the obligation to publish their annual financial statements. This also does not constitute an automatic extension of the deadline. The measure is aimed solely at making things easier for businesses. No further measures are currently being planned. The introduction of new enforcement measures is also included without modification.
